The Czech version of these legal texts is legally authoritative. This English translation keeps the same article numbers, defined terms, and structure.
1. Operator
The operator and provider of the Service is:
Tomáš Pukowiec
Dětmarovice 368
735 71 Dětmarovice
Czech Republic
Company ID (IČO): 75241587
VAT ID (DIČ): CZ8502085603
E-mail: support@mincast.ai
Telephone: +420 608 251 214
(the “Operator” or “Mincast”).
2. Who these Terms apply to
The Service may be used by consumers and traders.
A “Consumer” means a natural person who, when concluding and performing a contract with the Operator, is not acting within the scope of their trade, business, craft or profession.
A “Trader” means, for the purposes of these Terms, a user who uses the Service in connection with their trade, business or professional activity, or on behalf of a legal person or other organisation.
Provisions of these Terms expressly designated as Consumer rights apply only to Consumers. The statutory rights of a Consumer cannot be limited by these Terms.
3. Age and capacity
A Mincast account is intended for persons who have reached the age of at least 16 years.
If you are under 18 or are not fully capable under the law applicable to you of concluding the relevant contract, you may use the Service, and in particular enter into a paid subscription, only to the extent permitted by that law. If the consent of a legal representative is required, you must have it.
A paid subscription may be concluded only by a person authorised to use the relevant payment method.
4. What Mincast is
Mincast is a service for creating personalised news digests using automated and AI technologies.
A user may in particular:
- select news and other RSS sources,
- add their own publicly available RSS source,
- set topics, categories, priorities and other preferences,
- have a text AI digest created,
- use text-to-speech conversion of a digest,
- save links to articles,
- view the history of created digests,
- use notifications and optional weather features,
- publicly share a selected digest via a link.
Mincast is not its own newsroom and does not create original reporting about the events described. Digests are based on information from external sources and are processed automatically.
5. Account
Most features of the Service require creating an account.
Registration is possible via an e-mail address and password or via a supported external sign-in method, for example a Google account.
The user must provide true and up-to-date information and protect their login credentials against misuse.
The user must not allow an unauthorised third party to use their personal account. If you suspect misuse of the account, contact the Operator without delay.
The Operator may require verification of the e-mail address before making the account available.
6. Formation of the contract
For a free account, the contractual relationship arises upon creation of the account and acceptance of these Terms.
A paid subscription arises after the user selects a plan and billing period, receives information about the price and recurring charges before confirming the order, confirms an order that creates a payment obligation, and the payment or payment authorisation is successfully completed.
Before submitting the order, the user may review the selected plan, billing period, price and other displayed information.
Information about the concluded paid subscription and payment is made available to the user electronically, in particular through the account, the Stripe Customer Portal and a confirmation sent to the user’s e-mail address.
The current version of these Terms is available at mincast.ai.
7. Plans
Mincast may offer in particular the FREE, PRO and PREMIUM plans.
Individual plans may have different limits, in particular for the number of sources, the number or length of AI digests, history, saved items, TTS, notifications and other features.
The current features, limits and price of each plan are stated in the Service before a paid subscription is concluded.
The FREE plan may include advertising. Paid PRO and PREMIUM plans are, according to the current offer, provided without advertising.
The Operator may provide promo codes, time-limited offers, free trial or beta plans, or free access to selected users. Unless expressly stated otherwise, free or promo access does not create a right to its continuation or to its exchange for money.
8. Beta operation
The Service may for a period of time be operated as a closed or public beta version.
During beta operation, some features may be experimental, incomplete or changed more frequently. Errors or temporary outages may occur.
In a closed beta, some otherwise paid features may be provided free of charge. A paid subscription does not arise unless a price and a payment obligation are clearly displayed to the user before confirmation.
The beta nature of the Service does not limit Consumer rights that cannot be contractually excluded under applicable law.
9. Price, payments and Stripe
Payments for paid plans are technically processed by Stripe and its related companies.
The contractual provider of the Service remains the Operator of Mincast. Stripe is not the provider of the Mincast service itself.
The final price, currency, billing period, any taxes and the total amount payable are displayed to the user before the order is confirmed.
If the price is displayed as a price including tax, it includes the applicable tax according to the information available at the time of the order.
The Operator may, for tax, regulatory, sanctions, payment or other objective reasons, restrict the ability to purchase a paid subscription in some countries, even if a free account is available in that country.
10. Automatic renewal of the subscription
Monthly and annual subscriptions renew automatically for a further identical period until cancelled.
Upon each renewal, the price applicable to that subscription is charged, of which the user was informed in accordance with these Terms.
The subscription may be managed and cancelled in particular through the Stripe Customer Portal.
Ordinary cancellation of automatic renewal does not terminate the subscription immediately. The user may use the paid plan until the end of the period already paid for and the account is then, unless deleted, moved to the available free plan.
This is without prejudice to the Consumer’s statutory rights of withdrawal, complaint, price reduction or other claims.
11. Change of plan
The user may, if the current offer so allows, switch between the PRO and PREMIUM plans or change the billing period.
Before confirming the change, the user is shown its effect on the price and the time it takes effect.
When changing a plan, only a pro-rata part of the price difference may be charged, depending on the time of the change and the subscription settings, or a corresponding amount may be credited to the next period. The specific financial effect is shown to the user before the change is confirmed.
12. Price changes
The Operator may change the price of a paid subscription for the future.
A price change does not affect a billing period that has already been paid.
The Operator will inform an existing subscriber of a price increase by e-mail at least 30 days before the new price is first charged.
The user may cancel automatic renewal of the subscription before the new price takes effect.
If fewer than 30 days remain until the next renewal, the new price will apply only at a subsequent renewal so that the stated notice period is observed.
13. Consumer’s right to withdraw within 14 days
A Consumer who has concluded a paid subscription contract by distance means has the right to withdraw from the contract within 14 days of its conclusion, unless a legal provision provides otherwise.
To withdraw, the Consumer may use the model form at the end of these Terms or send another unequivocal statement to support@mincast.ai.
The Consumer may request that provision of the paid Service begin immediately after payment, that is before the 14-day period expires. If the Consumer subsequently withdraws within the statutory period and the statutory conditions for payment for performance already provided are met, the Consumer may be required to pay a pro-rata part of the price corresponding to the performance provided up to the time of withdrawal.
Any refund will be made without undue delay, no later than within the period set by law, generally by the same means as the payment was received, unless otherwise agreed.
Ordinary cancellation of automatic renewal under Article 10 is not the same as statutory withdrawal from the contract.
14. Quality of the digital service and Consumer rights for defects
The Operator provides the Service in accordance with the contract and to the extent required by law.
For a digital service provided on a continuous basis, the Operator is liable to the Consumer for the Service being free of defects for the duration of the obligation, to the extent laid down by law.
If the Service has a defect, the Consumer may require its removal, unless that is impossible or disproportionately costly.
Under the conditions laid down by law, the Consumer may require a reasonable price reduction or withdraw from the contract, in particular if the defect was not removed, recurs, or is so serious as to justify an immediate price reduction or withdrawal.
These statutory rights are not affected by notices concerning the nature of AI or third-party information.
15. Complaints
A Consumer may lodge a complaint by e-mail to:
support@mincast.ai
or in writing at:
Tomáš Pukowiec, Dětmarovice 368, 735 71 Dětmarovice, Czech Republic.
The complaint should in particular state the account e-mail, a description of the defect, when the defect appeared, and the remedy the Consumer requests.
The Operator will confirm receipt of the complaint and provide the Consumer with information on its handling.
A complaint concerning the digital service will be handled without undue delay and within a reasonable time having regard to the nature of the Service and the purpose for which the Consumer requested it, in accordance with the law.
16. News sources and third-party content
Mincast works with news and other third-party sources, in particular through publicly available RSS feeds and publicly available web pages.
Copyright and other rights in original articles, photographs, brands and other third-party content remain with their respective holders.
Mincast is designed so that the user is shown in particular Mincast’s own automated summary, the article title, the source designation and a link to the original source, not a copy of the original article.
The Operator may change, remove or stop processing any source in the catalogue, for example because of its unavailability, a change in technical conditions, a request of the rights holder, or legal reasons.
17. Custom RSS sources
In supported plans, the user may add their own publicly available RSS or Atom URL.
The user may add only a source whose use through Mincast does not infringe legal rules or third-party rights and which does not circumvent access restrictions, login, a paywall or other technical measures.
The Operator may refuse, block or remove a custom source in particular if it is non-functional, presents a security risk, breaches these Terms, there is a reasonable suspicion of infringement of third-party rights, or the rights holder requests its removal.
18. AI outputs
Digests and other summaries are created automatically using artificial-intelligence models.
AI may misunderstand information, oversimplify it, combine it with other information, omit an important fact, or produce a factually incorrect statement.
Mincast therefore does not guarantee that every AI digest will be complete, error-free or up to date.
For important decisions, the user should verify the information in the original source or another trustworthy source.
The Service is not intended as the sole basis for legal, health, financial, investment, safety or other similarly serious decisions.
This notice does not limit the Consumer’s statutory rights arising from defects in the Mincast digital service itself.
19. Saved articles and history
The “saved article” feature in Mincast generally stores a link to the original source, the title and related metadata, not a copy of the entire original article.
History may retain AI digests previously created by the user until the user deletes them or the account is deleted, unless otherwise stated for legal or technical reasons.
Availability of the original external article is not under Mincast’s control and may change over time.
20. Public sharing
The user may enable public sharing of a selected digest via a unique link.
A publicly shared digest may contain in particular the AI summary, article titles, source names and links to the original articles.
The public page does not contain the original full text of the articles or their RSS excerpt, unless expressly stated otherwise.
By enabling sharing, the user acknowledges that anyone who obtains the public link may view the content and pass the link on. A public link therefore cannot be treated as a private or confidential store.
The user may disable sharing. The Operator is also entitled to disable public sharing if it infringes legal rules, third-party rights or these Terms.
The Operator may be unable to remove copies or links stored outside Mincast’s systems, for example in search engines, caches or with third parties.
21. Rights in Mincast and licence
The software, graphical interface, the Mincast brand, original texts and other original elements of the Service are protected by the relevant rights of the Operator or its licensors.
For the duration of their authorised access, the user obtains a limited, non-exclusive and non-transferable right to use the Service for personal purposes or for their own internal business purposes.
This authorisation does not include the right to operate a copy of the Service, sell access to the Service, circumvent its limits, or systematically extract its databases.
Mincast does not guarantee that each individual AI output is or can be the subject of exclusive copyright.
The user may use their digests for their own needs and share them through the features provided by Mincast. Systematic or large-scale redistribution of outputs in a way that replaces the Service or the original sources may be restricted.
22. Prohibited use
The user must not in particular:
- use the Service contrary to legal rules,
- attempt to obtain unauthorised access to accounts, systems or data,
- circumvent security measures, plan limits or technical restrictions,
- intentionally overload the Service or disrupt its availability,
- scrape or extract the content or databases of the Service at scale without permission,
- use automation to circumvent quotas,
- add custom RSS sources contrary to Article 17,
- use the Service to disseminate unlawful content, harmful code, fraud or harassment,
- unlawfully present Mincast or its outputs as a third party’s own news source.
23. Availability and maintenance
Mincast does not undertake to provide the Service with guaranteed uninterrupted availability, unless a specific service level has been agreed with a particular user.
Planned and unplanned outages, maintenance, and outages of infrastructure providers, AI services, publisher sources or other external systems may occur.
The Operator will make reasonable efforts to restore availability and remedy faults.
24. Changes to the Service
Mincast is developed on an ongoing basis.
The Operator may change the Service in particular for reasons of:
- security,
- legal or regulatory requirements,
- changes of external providers,
- changes of sources or APIs,
- technical development,
- prevention of abuse,
- development of AI models,
- operating costs,
- improvement or further development of the product.
For a paid Service, a material change will not be made arbitrarily in breach of Consumer rights.
If a change to a continuously provided digital service significantly negatively affects the Consumer’s access to or use of the Service, the Consumer will be informed in advance to the extent required by law and will have the rights granted by law in that case.
Purely technical or security changes, or changes without a negative impact on the user, may be introduced without prior individual notice.
25. Suspension and termination of the account
The Operator may temporarily restrict or suspend the account or part of it, in particular if:
- the user seriously or repeatedly breaches these Terms,
- there is a suspicion of account compromise or a security incident,
- the user abuses quotas or infrastructure,
- payment for a paid plan fails,
- the restriction is required by law or a decision of a competent authority.
Where circumstances allow, the Operator will inform the user in advance or without undue delay of the reason for the restriction.
The user may delete their account through the function available in the application.
Deletion of the account also terminates further use of the Service. An active paid subscription must be terminated in connection with account deletion so that it does not continue to renew automatically after deletion.
Handling of personal data after account deletion is governed by the Privacy Policy.
26. Liability
Nothing in these Terms excludes or limits liability or rights that cannot be excluded or limited under mandatory legal provisions.
In particular, the Consumer’s statutory rights arising from defects in the digital service, non-provision of the service or an unlawful change of the service are not limited.
Mincast is not liable for the accuracy, availability or lawfulness of content published by independent third parties, unless a legal provision provides otherwise.
Users who are not Consumers
The following limitations apply only in relation to users who are not Consumers, and only to the extent such a limitation is permitted under applicable legal provisions.
The Operator is not liable for indirect or consequential harm, lost profit, loss of business opportunity or loss of data, unless a legal provision provides otherwise.
The Operator’s total obligation to compensate harm arising in connection with the Service towards a user who is not a Consumer is, to the extent permitted by law, limited to the amount that user actually paid the Operator for the Service during the 12 months immediately preceding the event from which the claim for compensation arose.
These limitations do not apply to harm caused intentionally or by gross negligence, nor in other cases where a legal provision does not permit limitation or exclusion of liability. If the user is a weaker party within the meaning of the applicable legal provisions, this article does not limit that user’s rights to the extent such a limitation is prohibited by law.
27. Personal data protection and cookies
The processing of personal data is governed by the separate Privacy Policy.
The use of cookies, localStorage, advertising identifiers and similar technologies is governed by the Cookie and Similar Technologies Policy.
28. Changes to these Terms
The Operator may reasonably change these Terms, for example following a change to the Service, legal requirements or the business model.
The user will be informed of a material change affecting an existing paid contractual relationship in an appropriate manner, for example by e-mail or a notice in the Service.
A change to the Terms does not of itself deprive the Consumer of rights granted by mandatory legal provisions.
The current version contains the date of the last update.
29. Governing law
The legal relationship between the user and the Operator is governed by the law of the Czech Republic.
If the user is a Consumer, this does not deprive them of the protection afforded by the mandatory provisions of the law of the country of their habitual residence, if such provisions apply under the relevant conflict-of-law rules.
Disputes between the Operator and a user who is not a Consumer are subject to the courts of the Czech Republic, unless a mandatory legal provision provides otherwise.
30. Out-of-court settlement of consumer disputes
If a dispute arises between the Operator and a Consumer that cannot be resolved directly, the Consumer may submit a proposal for out-of-court settlement of the consumer dispute.
